Terms and Conditions

Your use of the website www.privileges.hsbcpremier.com (the "Site") and the HSBC Premier Privileges Programme (the "Programme") is conditional upon your acceptance of the following Terms and Conditions, as set out below from time to time:

In each of the Terms and Conditions:

  • references to 'you', 'your' and 'yours' are references to the person(s) accessing the Site or any Local Site (as defined below);
  • references to 'we', 'us', 'our', 'ours' and 'ourselves' are references to The Hongkong and Shanghai Banking Corporation Limited;
  • references to the 'HSBC Group' are references to HSBC Holdings plc, its subsidiaries and affiliated companies;
  • references to 'Programme Participants' are to third party providers of a discount, upgrade or other offer to users of the Programme; and
  • references to  'HSBC cardmembers' in a Local Site (as defined below) shall have the same meaning as 'HSBC cardholders' referred to in these Terms and Conditions   



The following sets out the terms of use of the Site.

The Site provides information to customers of the HSBC Group about third parties who may be prepared to make offers and discounts available to certain customers of the HSBC Group and provides a portal or gateway to the financial services offered by members of the HSBC Group.

The Site is operated by us, a wholly owned subsidiary of HSBC Holdings plc, the holding company of the HSBC Group.

We are a founding member of the HSBC Group. Our head office is situated at HSBC Main Building,1 Queen's Road, Central, Hong Kong.

We are an authorized institution in Hong Kong regulated by the Hong Kong Monetary Authority.

The Site is currently intended for those who access it from within the following countries: Argentina, Australia, Bahrain, Bermuda, Brazil, Brunei Darussalam, Canada, Cayman Islands, Chile, China, Colombia, Egypt, France, Greece, Hong Kong SAR, India, Indonesia, Jersey, Jordan, Lebanon, Macau SAR, Malaysia, Malta, Mauritius, Mexico, Oman, Pakistan, Panama, Paraguay, Philippines, Qatar, Saudi Arabia, Singapore, Sri Lanka, Taiwan, Thailand, Turkey, Vietnam, Saudi Arabia, United Arab Emirates, United Kingdom, United States. Because of this we cannot guarantee that the Site or the information thereon complies with or is appropriate for use in other places.

The provision of financial services or products

The Site does not offer financial services or products and the Site, or gateway, does not constitute an offer of any financial products or services provided by HSBC Group members.

Not all the products and services that you may be able to view via the Site (including via links) are available in all geographical locations. We and/or the relevant HSBC Group member reserve the right to make the final determination on whether or not you are eligible for any particular product or service.

Local Sites

You may link to other HSBC websites or pages issued by other entities within the HSBC Group ("Local Sites") through the Site. Your use of any Local Site shall be governed by both these Terms and Conditions and the terms and conditions of the Local Site. However, where these Terms and Conditions conflict with those of the Local Site, the terms and conditions of the Local Site shall prevail.

All products and services provided by members of the HSBC Group in Local Sites are subject to the terms and conditions and disclaimers of the applicable agreement governing their supply and use ("Product terms and conditions"). Where Product terms and conditions conflict with these Terms and Conditions or any Local Site's terms and conditions the Product terms and conditions shall prevail.

The products and services offered on Local Sites may be limited to persons located or residing in only that particular jurisdiction. In addition, the content on these linked websites may not be intended for persons located or residing in jurisdictions that restrict the distribution of such content.

Governing Law

  • All practical steps will be taken to ensure that personal data will not be kept longer than necessary and that we will comply with all statutory and regulatory requirements in the Hong Kong Special Administrative Region concerning the retention of personally identifiable information.

Security Assurance

  • Both you and we play an important role in protecting against online fraud. You should be careful that your account details including your Username and/or Password are not compromised by ensuring that you do not knowingly or accidentally share, provide or facilitate unauthorised use of it. Do not share your Username and/or Password or allow access or use of it by others. We endeavor to put in place high standards of security to protect your interests.
  • You should safeguard your unique Username and Password by keeping it secret and confidential. Never write them down or share these details with anyone. We will never ask you for any HSBC Internet Password, including your Internet Banking Password, in order to ensure that you are the only person who knows this information. When choosing your unique Username and Password for the first time, do not create it using easily identifiable information such as your birthday, telephone number or a recognisable part of your name. If you think your Username and/or password has been disclosed to a third party, is lost or stolen and unauthorised transactions may have been conducted, you are responsible to inform us immediately.

  • Marketing Promotions

    Occasionally we may collect personal information from visitors to this site and those individuals that participate in a contest or promotion (online or over the telephone, or at one of our branches). Such information is only collected from individuals who voluntarily provide us with their personal information. Notice to Customers Relating to the Personal Data (Privacy) Ordinance

This Statement is made by us in accordance with the Personal Data (Privacy) Ordinance of the Hong Kong Special Administrative Region ('the Ordinance') and applies to customers of the Bank. For customers of other HSBC Group entities, please refer to the local privacy policy in your jurisdiction.

The Statement is intended to notify you why personal data is collected, how it will be used and to whom data access requests are to be addressed.

  1. Why we collect your data
    From time to time, we collect your personal information to carry out and administer our services to you and in an effort to improve your customer experience.
  1. Without such data we may be unable to open or continue accounts or establish or continue banking facilities or provide banking services.
  1. Data is also collected from customers in the ordinary course of business to continue the banking relationship, for example, when customers write cheques, deposit money or apply for credit. This includes information obtained from Credit Reference Agencies.
  1. How your data may be used
    Data relating to a customer may be used to:
    1. facilitate the daily operation of the services and credit facilities provided to customers;
    2. conduct credit checks (including without limitation upon an application for consumer credit and upon periodic review of the credit);
    3. create and maintain our credit and risk related models;
    4. assist other financial institutions to conduct credit checks and collect debts;
    5. ensure ongoing credit worthiness of customers;
    6. design financial services or related products for customers' use;
    7. market services or products of ours and/or selected companies;
    8. determine the amount of indebtedness owed to or by customers;
    9. collect amounts outstanding from customers and those providing security for customers' obligations;
    10. meet the disclosure requirements of any law binding on us or any of our branches;
    11. enable an actual or proposed assignee of ours, or participant or sub-participant of our rights in respect of the customer to evaluate the transaction intended to be the subject of the assignment, participation or sub-participation; and
    12. to fulfill any other purposes relating thereto.
  1. Disclosure of your personal information
    Information held by us relating to a customer will be kept confidential but we may provide such information to the following parties (whether within or outside the Hong Kong Special Administrative Region) for the purposes set out in paragraph (d):
    1. any agent, contractor or third party service provider who provides administrative, telecommunications, computer, payment or securities clearing or other services to us in connection with the operation of our business;
    2. any other person under a duty of confidentiality to us including a group company of ours which has undertaken to keep such information confidential;
    3. the drawee bank providing a copy of a paid cheque (which may contain information about the payee) to the drawer;
    4. a person making any payment into the customer's account (by providing a copy of a deposit confirmation slip which may contain the name of the customer);
    5. credit reference agencies, and, in the event of default, to debt collection agencies;
    6. any person to whom we are under an obligation to make disclosure under the requirements of any law binding on us or any of our branches or under and for the purposes of any guidelines issued by regulatory or other authorities with which we or any of our branches are expected to comply;
    7. any actual or proposed assignee of ours or participant or sub-participant or transferee of our rights in respect of the customer; and
    8. selected companies for the purpose of informing customers of services which we believe will be of interest to customers.

    In connection with (v) above, in the event of any default in payment where the amount in default is not fully repaid before the expiry of 60 days as measured by us from the date such default occurred, the customer is liable to have his account data retained by the credit reference agency at least until the expiry of 5 years from the date of final settlement of the amount in default before the right referred to in (f)(v) below may be exercised.

  1. Data access requests
    Under the terms of the Ordinance and the Code of Practice on Consumer Credit Data approved and issued under the Ordinance, any individual has the right:
    1. to check whether we hold data about them and of access to such data;
    2. to require us to correct any data relating to them which is inaccurate;
    3. to ascertain our policies and practices in relation to data and to be informed of the kind of personal data held by us;
    4. in relation to consumer credit, to request to be informed which items of data are routinely disclosed to credit reference agencies or debt collection agencies, and be provided with further information to enable the making of an access and correction request to the relevant credit reference agency or debt collection agency; and
    5. (except where the consumer credit applied for involves a residential mortgage loan) upon satisfactory termination of the credit by full repayment and on condition that there has been, within 5 years immediately before such termination, no material default under the credit as determined by us, to instruct us to make a request to the relevant credit reference agency to delete from its database any account data relating to the terminated credit.

Operation of the Programme

The HSBC Premier Privileges Programme ('the Programme') introduces customers to third parties who may be prepared to make offers and discounts available to certain customers of HSBC.

All offers detailed on this Site are provided by third parties and subject to their terms and conditions.. If you have any queries regarding any of the offers, please contact the third party who is providing the offer.

The third party offers are promoted on the Site, which is operated by us. Country-specific terms may apply to the offers from time to time available in different countries.

Eligibility to Participate in the Programme

Please see the specific eligibility criteria of each third party offer.

Generally, the third parties will make any offers available to holders of an Eligible Card.

An 'Eligible Card' means a credit card bearing the 'HSBC Premier' name and logo, any credit card issued by an HSBC Group member or any other credit card notified in writing by us to you as being an Eligible Card from time to time but excluding certain co-branded credit cards as specified by us or other HSBC Group member(s) from time to time (which may be different from territory to territory) (unless expressly stated otherwise in respect of any benefit, any Programme Participant or any jurisdiction on this Site or otherwise). Third parties may only make certain offers available to holders of particular cards. Please refer to the specific eligibility criteria of each third party offer for further details.

HSBC may terminate your use of the Programme immediately without notice and for any reason (unless otherwise required by relevant regulatory bodies/agencies/court order in which event we will comply with relevant legal, regulatory or judicial requirement), including if you:
a. do not comply with the Terms and Conditions;
b. do not comply with the terms and conditions of an Eligible Card;
c. cease to be the holder of an Eligible Card (i.e. your account is cancelled); or
d. abuse any privilege offered to you under the Programme.

Benefits Under the Programme

The offers and discounts are listed on the Site and may also be listed in general advertising material from time to time.

The offers promoted on the Site may be changed or withdrawn at any time without prior notice notice either by HSBC or by third party offer provider.

All offers and discounts are subject to availability and other terms and conditions imposed by the third party providers of the offers.

Unless otherwise stated, no offer or discount may be used in conjunction with any other offers, discounts, promotional offers or programmes, discounted items, shopping and dining coupons, membership benefits, fixed-price items, privilege card(s), loyalty programmes, or in-house offers. The offers, and any rights they confer, cannot be sold, transferred, assigned, exchanged for cash, other products or discounts or otherwise dealt with except in accordance with the Terms and Conditions.

To claim an offer you must follow any specific instructions of the third party as detailed on the Site or as subsequently notified to you by the third party. In general, in order to claim an offer, you should:

  1. state the redemption of the offer during any advance booking; and
  2. settle payment with your Eligible Card or quote details of, show or use your Eligible Card at the time of transaction; If an offer is only available to HSBC Premier credit cardholders, such cardholders must settle payment with their HSBC Premier MasterCard? credit card.

Limitations and conditions may apply in relation to offers and availability of such offers during public holidays, festivities or other dates as specified by the respective third party providers. Please check with respective third party providers for details.

The offer periods and terms and conditions of each third party's offer are subject to change without prior notice. Neither we nor any other HSBC Group member accepts any liability for any such change and nor will they notify cardholders separately of any such change.

In the case of any dispute, our decision and that of the respective third party providers shall be final.

Liability

We have taken and will take all reasonable care to ensure that information we published on the Site is accurate, but neither we nor any other HSBC Group member accepts any liability relating to information provided by third parties. Neither we nor any other HSBC Group member makes any representations on behalf of any third party provider.

All descriptions of offers published on the Site are based on information supplied by third party offer providers. All information is accurate at the time of publication but may be subject to change subsequently. . Other special terms and conditions relating to the offers may also apply. Neither we nor any other HSBC Group member shall be responsible for:

  1. any benefit you receive under the Programme;
  2. to the extent permitted by law, any death or injury or consequential loss or damage from a benefit; or
  3. representations made by a third party provider in respect of any offer
  4. any loss, theft or destruction of a benefit or a voucher.

Neither we nor any other HSBC Group member shall be liable for:

  1. any unauthorised use of the Programme;
  2. any failure by you to notify a third party provider that a transaction is eligible for a benefit under the Programme;
  3. any offer or discount not being available from a third party provider for any reason;
  4. any failure by a third party provider to meet the terms and conditions on which it has agreed to provide an offer or discount;
  5. any failure to notify you of any change in the Terms and Conditions, the terms and conditions of a third party provider, the offers, discounts, the third party providers or qualifying goods and services;
  6. the suspension and/or termination of the Programme; or
  7. any malfunction, delay in replacing, or unauthorised use of Eligible Cards. The provisions of this sub paragraph (g) shall not apply if the Eligible Card was issued in any of the United Kingdom, the countries of the European Union or countries in the European Economic Area.

The third party providers of the offers and discounts do not have any authority, express or implied, to make any representations, warranties or statements on behalf of any HSBC Group member. All contractual obligations are between you and the third party provider.

Any tax which is payable arising from your participation in the Programme is your responsibility, including any goods and services tax.
